1. Agreement to Terms

Welcome to AI Top Trends. By accessing or using aitoptrends.com — including any related media channels, mobile website, or mobile application (collectively, the "Site") — you confirm that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy.

These Terms constitute a legally binding agreement between you and AI Top Trends, LLC, a limited liability company organized under the laws of the United States.

If you do not agree with these Terms, please discontinue use of the Site immediately.

You must be at least 18 years of age to use this Site. By using the Site, you represent that you meet this requirement.

2. Modifications to Terms

We reserve the right to update or modify these Terms at any time, at our sole discretion. When we do, we will revise the "Last Updated" date at the top of this page. For material changes, we may also notify you via email or a prominent notice on the Site.

3. Intellectual Property Rights

All content on the Site — including but not limited to source code, databases, software, website designs, audio, video, text, photography, graphics, trademarks, service marks, and logos (collectively, "Content" and "Marks") — is owned by or licensed to AI Top Trends, LLC, and is protected under U.S. and international copyright, trademark, and intellectual property laws.

We reserve the right to remove any user-generated content at our sole discretion, without notice.

To the fullest extent permitted by law, AI Top Trends, LLC expressly disclaims all warranties, including but not limited to:

  • Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
  • That the Site will be uninterrupted, error-free, or secure
  • That any information on the Site is accurate, reliable, or complete
  • That defects will be corrected

Your use of the Site is solely at your own risk.

8. Limitation of Liability

To the maximum extent permitted by applicable law, AI Top Trends, LLC, its directors, employees, partners, agents, suppliers, and affiliates shall not be liable for any:

This limitation applies even if AI Top Trends, LLC has been advised of the possibility of such damages.

In no event shall our total liability to you exceed $100 USD or the amount you paid us in the past six (6) months, whichever is greater.

9. Indemnification

You agree to defend, indemnify, and hold harmless AI Top Trends, LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses — including reasonable attorneys' fees — arising out of or in any way connected with:

  • Your access to or use of the Site
  • Your violation of these Terms
  • Your violation of any third-party rights, including intellectual property rights
  • Any content you submit to the Site

10. Dispute Resolution & Arbitration

Please read this section carefully. It affects your legal rights.

Informal Resolution

Before filing any formal claim, you agree to first contact us at info@aitoptrends.com and attempt to resolve the dispute informally. We will make reasonable efforts to resolve the issue within 30 days.

Binding Arbitration

If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the Site shall be resolved by binding arbitration administered under the rules of the American Arbitration Association (AAA), rather than in court — except that either party may bring individual claims in small claims court.

Class Action Waiver

YOU AND AI TOP TRENDS, LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION.

Unless both parties agree otherwise, an arbitrator may not consolidate more than one person's claims.

Opt-Out

You may opt out of arbitration within 30 days of first accepting these Terms by emailing us at info@aitoptrends.com with the subject line "Arbitration Opt-Out."

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles. For disputes not subject to arbitration, both parties consent to the exclusive jurisdiction of the state and federal courts located in Delaware.

12. Termination

We reserve the right to suspend or terminate your access to the Site at our sole discretion, without notice, for any reason — including violation of these Terms. Upon termination, your right to use the Site ceases immediately.
